Use Netlaw's post judgment calculator to calculate interest on an unpaid judgment debt in the Local Court. Legislation prescribes interest to be paid on a judgment debt pursuant to s.101 of the CPA 2005 unless the Local Court orders otherwise. Practitioners will note that the judgment detor has 28 days from the date judgment takes effect to pay the judgment debt in full without interest, again, unless the Local Court orders otherwise. Although the aforementioned legislation states that interest is to be calculated at the "prescribed rate" or at any rate the Court orders, Netlaw calculates the rate of post judgment interest as set by Regulation 36.7 of the Uniform Civil Procedure Rules 2005, as presribed s101(7) of the CPA. For the purpose of our Local Court Calculator, the interest rate prescribed by Reg.36.7 of the Rules is (a) in respect of the period from 1 January to 30 June in any year--the rate that is 6% above the cash rate last published by the Reserve Bank of Australia before that period commenced, and (b) in respect of the period from 1 July to 31 December in any year--the rate that is 6% above the cash rate last published by the Reserve Bank of Australia before that period commenced. Litigants are able to seek Orders for interest on unpaid costs in accordance with the above provisions as set out in s.101 of the CPA. Practitioners and users of our interest calculators should seek their own legal advice, information and conduct their own research rather than rely on information provided on this website.
