Netlaw does not provide pre-judgment interest calculations in the District Court for claims on which interest is applicable or sought to be applicable prior to July 1 2010. Sould you wish to make your own calclations for such claims we are building a calculator which will be ready soon. Use Netlaw's District Court Interest Calculator to calculate pre-judgment interest on civil debt claims within its monetary jurisdiction (i.e - claims in excess of A$100,00.00 but limited to A$750,000.00 unless the parties agree otherwise).
The power of the District Court of NSW to order interest on a claim for civil debt from the date of the cause of action (i.e - pre-judgment debt) is discretionary and conferred by section 100 of the Civil Procedure Act 2005. The District Court Civil Procedure Practice Notes provide that Practitioners should expect that the District Court will have regard to the rates established by the Discount and Interest Rate Harmonisation Committee.
The pre-judgment interest rates applicable in the District Court civil jurisdiction post 1 July 2010 as set by the Committee are the basis on which Netlaw calculates interest and are calculated as follows:
(a) in respect of the period from 1January to 30 June in any given year - the rate that is 4% above the cash rate last published by the Reserve Bank of Australia before that period commenced and the same again for the period 1 July to 31 December in any year being 4% above the last published cash rate by the RBA prior to that period commencing.
